Terms and Conditions
Effective date: July 17, 2026
These Terms and Conditions govern your access to and use of PathwayCounselor (the “Service”), including our website, dashboard, AI counselor chat, college and scholarship tools, and related features. By creating an account or using the Service, you agree to these Terms.
1. The Service
PathwayCounselor provides AI-assisted academic planning support for high school students, including course guidance, pathway planning, college research, scholarship discovery, deadline tracking, and related educational resources.
PathwayCounselor is a technology tool, not a licensed school counselor, attorney, financial advisor, or agent of any school district. Advice from the Service is informational only and may be incomplete or incorrect. For official schedule changes, graduation determinations, transcript requests, disciplinary matters, mental health crises, or other sensitive issues, contact your school counselor or another appropriate professional.
2. Eligibility and Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.
If you are under 18, you represent that you have permission from a parent or guardian to use the Service where required by law. Parents and guardians who create or manage accounts for students are responsible for supervising that use.
3. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, harassing, or fraudulent purposes
- Attempt to reverse engineer, scrape, disrupt, or overload the Service
- Upload or share content you do not have the right to share
- Misrepresent your identity, school affiliation, or academic credentials
- Use the Service to obtain advice intended to circumvent school rules, academic integrity policies, or applicable law
- Share account access with others or resell access without our written permission
4. AI Features and Accuracy
Parts of the Service use artificial intelligence and third-party models. Outputs can be inaccurate, outdated, or inconsistent with your district’s current policies. Always verify important decisions with official school resources and counselors.
You remain responsible for the academic and personal decisions you make based on information from the Service.
5. School and Third-Party Data
Some features may let you connect school systems (such as Home Access Center), import academic information, or search external data sources such as college or scholarship databases. Those systems are operated by third parties and are subject to their own terms and availability.
We do not guarantee uninterrupted access to third-party systems, and we are not responsible for errors originating from those systems.
6. Subscriptions and Payments
PathwayCounselor may offer free and paid plans, including Pathway Pro. Paid features, pricing, and limits are described on our pricing or billing pages and may change over time.
If you purchase a subscription, you authorize us and our payment processor to charge the applicable fees on a recurring basis until you cancel. Taxes may apply. Unless required by law, fees are non-refundable except where we expressly state otherwise.
You may cancel a paid subscription through the billing portal or account settings. Cancellation generally stops future renewals; it does not automatically refund the current billing period.
7. Intellectual Property
PathwayCounselor, including its branding, software, design, and content we create, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial educational purposes.
You retain rights to content you submit, and you grant us a license to host, process, and use that content as needed to operate and improve the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS OR REFLECT CURRENT SCHOOL POLICY.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHWAYCOUNSELOR AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $50.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination will survive.
11. Changes
We may update these Terms from time to time. If changes are material, we will post the updated Terms on this page and update the effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Contact
Questions about these Terms can be sent through the contact options listed on pathwaycounselor.org or by reaching out to the PathwayCounselor team using the support channels provided in the product.
